PARTICIPANT DECLARATION, ASSUMPTION OF RISK AND RELEASE OF LIABILITY AGREEMENT

ΙMPORTANT NOTICE

This Participant Declaration, Assumption of Risk and Release of Liability Agreement (the "Agreement") is a legally binding agreement between the Participant and S BODY AND MIND PRODUCTIONS LTD (hereinafter referred to as the "Organizer").

This Agreement applies to all sporting events organized, promoted or managed by the Organizer, including, but not limited to:

• Road Running Events

• Trail Running Events

• Cross Country Events

• Mountain Running Events

• Open Water Swimming Events

• Aquathlon Events

• Duathlon Events

• Relay Events

• Youth Events

• Training Sessions

• Test Events

• Promotional Sporting Activities

• Any other sporting or recreational activity organized by the Organizer.

SHORT SUMMARY (IMPORTANT KEY POINTS)

By participating in any event organised by S BODY AND MIND PRODUCTIONS LTD, you acknowledge and agree that:

• You participate entirely at your own risk and voluntarily choose to take part in the Event.

• You confirm that you are physically and medically fit, properly trained, and capable of participating safely.

• You understand that sports events—especially endurance and open water activities—involve inherent risks, including injury, illness, or even death.

• You accept full personal responsibility for your health and safety before, during, and after the Event.

• You agree to stop immediately and seek assistance if you feel unwell or unable to continue safely.

• You release the Organizer from liability for any injury, loss, or damage arising from your participation to the fullest extent permitted by law.

• You understand that the Organizer implements safety measures but cannot eliminate all risks or guarantee your safety.

• You authorise the provision of emergency medical treatment if required and accept responsibility for any related costs not covered by insurance.

• You confirm that you have appropriate insurance coverage, where necessary.

• You grant permission for the use of your image, name, and results for event promotion and communication purposes.

• You agree to the processing of your personal data in accordance with applicable data protection laws.

If you do not agree with any of the above, you should not participate in the Event.

Participation in any Event organized by S BODY AND MIND PRODUCTIONS LTD is subject to acceptance of this Agreement.

By registering for an Event, collecting a race bib, entering the competition area or participating in any Event organized by the Organizer, the Participant confirms that they have carefully read, fully understood and voluntarily accepted all the terms contained in this Agreement.

If the Participant does not agree with any provision of this Agreement, they must not register for or participate in the Event.

DEFINITIONS

For the purposes of this Agreement:

Organizer means S BODY AND MIND PRODUCTIONS LTD, together with its directors, officers, employees, contractors, volunteers, sponsors, partners, service providers and authorised representatives involved in the organisation or operation of an Event.

Event means any sporting, recreational, promotional, training or competitive activity organised, promoted or managed by the Organizer.

Participant means any person who registers for, attends or participates in an Event in any capacity.

Competition Officials include, but are not limited to, the Race Director, Chief Referee, Medical Team, Water Safety Team, course marshals, timing personnel, volunteers and any person officially appointed by the Organizer.

1. PARTICIPANT DECLARATION

By registering for an Event, I voluntarily declare, represent and warrant that:

• I am participating voluntarily and entirely at my own risk.

• I am physically, mentally and medically fit to participate.

• I possess the knowledge, skills, experience and physical ability appropriate for the Event in which I have chosen to participate.

• I have undertaken adequate preparation and training appropriate for the Event.

• I have not been advised by a qualified medical professional not to participate in strenuous sporting activities.

• I am solely responsible for determining whether I am capable of participating safely.

• I will immediately withdraw from the Event should I feel unable to continue safely.

I acknowledge that the Organizer has accepted my registration in reliance upon these declarations.

2. PERSONAL RESPONSIBILITY

I acknowledge that I am solely responsible for monitoring my own physical and medical condition before, during and after the Event.

No statement, encouragement, advice or decision made by the Organizer, Competition Officials, volunteers, medical personnel or any other person shall replace my personal responsibility to determine whether I am capable of participating safely.

Should I experience pain, dizziness, breathing difficulty, chest discomfort, confusion, excessive fatigue or any other symptom that may compromise my safety, I agree to stop participating immediately and seek assistance from the nearest Competition Official or member of the Medical Team.

I understand that any decision to continue participating despite such symptoms shall be entirely at my own risk.

3. MEDICAL DECLARATION

I understand that participation in sporting activities places significant physical demands on the human body.

I declare that I suffer from no medical condition that would make my participation unsafe.

I acknowledge that the Organizer does not conduct medical examinations and accepts no responsibility for determining my medical fitness to participate.

I understand that it is entirely my responsibility to obtain appropriate medical advice before participating in any Event.

4. ASSUMPTION OF RISK

I fully understand and acknowledge that participation in any Event organised by the Organizer involves inherent, obvious and unforeseeable risks, many of which cannot be eliminated regardless of the care, planning, supervision or safety measures implemented by the Organizer.

I acknowledge that participation is entirely voluntary and that I freely choose to participate with full knowledge of these risks.

I understand and accept that participation in sporting activities may expose me to hazards that could result in:

• minor or serious physical injury;

• illness;

• permanent disability;

• psychological trauma;

• property loss or damage;

• financial loss;

• death.

Without limiting the general nature of the above, I acknowledge that such risks may include, but are not limited to:

Environmental Risks

• adverse weather conditions;

• high or low temperatures;

• rain;

• wind;

• storms;

• lightning;

• reduced visibility;

• darkness or limited lighting;

• uneven terrain;

• road surfaces;

• trails;

• mountains;

• forests;

• rivers;

• lakes;

• the sea;

• waves;

• tides;

• currents;

• slippery surfaces;

• rocks;

• natural obstacles;

• falling branches;

• loose gravel;

• mud;

• dust;

• wildlife;

• marine life;

• insects;

• animals.

Physical Risks

• falls;

• slips;

• trips;

• collisions with other participants;

• collisions with spectators;

• collisions with volunteers or officials;

• collisions with vehicles, bicycles or support equipment;

• overexertion;

• dehydration;

• heat exhaustion;

• heat stroke;

• hypothermia;

• muscle cramps;

• fatigue;

• respiratory distress;

• allergic reactions;

• fractures;

• head injuries;

• cardiac events;

• drowning;

• permanent disability;

• death.

Operational Risks

I acknowledge that risks may also arise from circumstances beyond the reasonable control of the Organizer, including but not limited to:

• failure or malfunction of timing systems;

• communication failures;

• equipment failure;

• delayed emergency response;

• actions or omissions of other participants;

• actions of spectators or third parties;

• traffic;

• public access to the course;

• unforeseen incidents;

• emergency situations;

• any other foreseeable or unforeseeable circumstance associated with participation in sporting activities.

I expressly acknowledge that the above list is not exhaustive and that other risks, whether known or unknown, foreseeable or unforeseeable, may exist.

I voluntarily and knowingly assume full responsibility for all risks associated with my participation before, during and after the Event.

I further acknowledge that my decision to participate is made freely, voluntarily and with full appreciation of the nature and extent of the risks involved.

5. RELEASE OF LIABILITY

To the fullest extent permitted by the laws of the Republic of Cyprus, I, on behalf of myself, my heirs, executors, administrators, legal representatives, successors and assigns, hereby voluntarily, irrevocably and unconditionally release, waive and discharge the Organizer from any and all claims, demands, actions, proceedings, liabilities, damages, losses, costs and expenses of every kind or nature whatsoever, whether known or unknown, arising directly or indirectly from my participation in any Event.

This Release applies to any claim arising before, during or after the Event, including, without limitation, claims relating to:

• bodily injury;

• illness;

• disease;

• permanent disability;

• emotional distress;

• psychological injury;

• property loss or damage;

• financial loss;

• medical treatment;

• emergency rescue operations;

• evacuation;

• transportation;

• death; and

• any other loss or damage arising from or connected with my participation in the Event.

I acknowledge that this Release applies regardless of whether the injury, loss or damage results from natural conditions, the acts or omissions of other participants, spectators or third parties, equipment failure or any circumstance beyond the reasonable control of the Organizer.

Nothing contained in this Agreement shall exclude or limit any liability which cannot lawfully be excluded or limited under the applicable laws of the Republic of Cyprus.

6. ORGANIZER'S RESPONSIBILITIES

I acknowledge that the Organizer is committed to implementing reasonable safety measures appropriate to the nature of each Event.

Such measures may include, where appropriate:

• qualified Competition Officials;

• medical personnel;

• first aid services;

• rescue teams;

• safety equipment;

• communication systems;

• course supervision;

• emergency response procedures.

However, I understand and acknowledge that no sporting event can be made completely free from risk and that the implementation of safety measures does not eliminate the inherent risks associated with participation.

I further acknowledge that the Organizer does not guarantee my personal safety before, during or after the Event.

7. MEDICAL TREATMENT CONSENT

If I become injured, ill, unconscious or otherwise unable to make informed decisions during the Event, I authorise the Organizer, Competition Officials, Medical Team, emergency services or any healthcare professional acting on their behalf to provide, arrange or authorise any medical treatment considered reasonably necessary for my health and safety.

Such treatment may include, without limitation:

• first aid;

• emergency medical treatment;

• evacuation;

• transportation by ambulance, rescue vehicle or rescue craft;

• hospital admission;

• surgery;

• administration of medication;

• any other emergency medical intervention considered necessary.

Where circumstances reasonably permit, every effort will be made to notify my emergency contact.

I acknowledge that I remain solely responsible for any medical expenses not covered by my own insurance or by any insurance policy that may be applicable under law.

8. INSURANCE

I understand and acknowledge that I am solely responsible for obtaining and maintaining adequate medical, accident, travel and personal liability insurance appropriate for my participation in the Event.

Unless expressly stated otherwise in writing by the Organizer, no individual insurance coverage is provided for Participants.

I acknowledge that any insurance maintained by the Organizer is intended solely to satisfy the Organizer's legal obligations and shall not be interpreted as providing personal insurance coverage for Participants.

9. MEDIA CONSENT

I acknowledge that photographs, video recordings, television broadcasts, drone footage, live streaming and other forms of media may be captured before, during and after the Event.

I hereby grant the Organizer an irrevocable, worldwide, royalty-free and perpetual licence to use, reproduce, publish, distribute and display my name, image, likeness, voice, race number and race results in connection with the promotion, reporting, documentation and marketing of the Event or future Events organised by the Organizer.

Such use may include printed publications, websites, social media platforms, television broadcasts, promotional campaigns and any other media now existing or developed in the future.

No compensation or royalty shall be payable in respect of such use.

10. PERSONAL DATA

I acknowledge that the Organizer will collect, store and process my personal data for purposes including, but not limited to:

• registration and participant identification;

• event administration;

• safety management;

• medical emergencies;

• electronic timing and race results;

• communication before and after the Event;

• publication of official results;

• legal and regulatory compliance.

The Organizer shall process personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and the Protection of Natural Persons with regard to the Processing of Personal Data Law of Cyprus (Law 125(I)/2018), as amended.

Where my separate consent is required by law for marketing communications, such consent shall be requested independently of this Agreement.

11. PARTICIPANTS UNDER 18 YEARS OF AGE

Participants under the age of eighteen (18) may only participate where registration has been completed and this Agreement has been accepted by a parent or legal guardian authorised to act on the Participant's behalf.

The parent or legal guardian confirms that they have the legal authority to accept this Agreement and assume the obligations contained herein on behalf of the minor Participant.

12. ENTIRE AGREEMENT

I acknowledge that this Agreement shall be read together with:

• the Official Competition Rules;

• the Official Event Guide;

• the Organizer's Registration Terms and Conditions;

• the Organizer's Privacy Policy.

Together, these documents constitute the complete contractual relationship between the Participant and the Organizer.

In the event of any inconsistency, this Agreement shall prevail with respect to matters relating to assumption of risk, participant declarations and the release of liability.

13. SEVERABILITY

If any provision of this Agreement is held by a court of competent jurisdiction to be invalid, unlawful or unenforceable, such provision shall be interpreted to the maximum extent permitted by law or, where necessary, severed from this Agreement.

The remaining provisions shall remain valid, binding and fully enforceable.

14. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and interpreted in accordance with the laws of the Republic of Cyprus.

Any dispute arising out of or in connection with this Agreement or the Participant's involvement in any Event shall be subject to the exclusive jurisdiction of the Courts of the Republic of Cyprus.

15. PARTICIPANT ACKNOWLEDGEMENT AND ACCEPTANCE

By registering for or participating in any Event organised by S BODY AND MIND PRODUCTIONS LTD, I expressly acknowledge and confirm that:

• I have carefully read this Agreement in its entirety.

• I fully understand its contents and legal consequences.

• I have had sufficient opportunity to ask questions and, if I considered it necessary, obtain independent legal advice before accepting this Agreement.

• I understand that by accepting this Agreement I may be waiving certain legal rights to the fullest extent permitted by applicable law.

• I freely and voluntarily accept all of the terms contained in this Agreement without coercion, pressure or undue influence.

• I understand that my acceptance of this Agreement is a condition of participation in any Event organised by the Organizer.

By completing the registration process, collecting my race materials or participating in any part of an Event, I confirm my acceptance of this Agreement.

16. VOLUNTARY EXECUTION OF THIS AGREEMENT

I acknowledge that I have read this Agreement carefully, that I fully understand its contents and legal effect, and that I accept it voluntarily and of my own free will.

I understand that this Agreement is legally binding and that my acceptance is a condition of participation in any Event organised by the Organizer.
